Q. How do the new laws work in relation to tenant damage?

A.  Where a tenant damages a property, they are only liable to pay the landlords insurance excess or the equivalent of four weeks rent, whichever is the lesser.  However, tenants are liable for each ‘event’ which causes damage.  Let’s say the tenant spills red wine on your nice new white carpet (you should have spoken to us at Propertyscouts before you chose that carpet) and in another room the tenants pet damages the carpet.  That’s two events, so two insurance claims and two excesses that the tenant is liable for.  In the case of intentional damage, the tenant can be held liable for the total damage caused.
